Terms of Sale
This Terms of Sale (“Agreement”) applies to the orders (“Order”) you place through Cheerble Online Store (“Website”),
which is a legal agreement between you and Shenzhen Cheerble Technology Co., Ltd. and its affiliates, subsidiaries,
and divisions as may change from time to time (collectively, “Cheerble”, “we”, “us” and “our”).
This Agreement applies to the purchases of products and/or services (“Products”, “Goods” and “Items”) on or through the Website.
Based on your territory and/or the delivery territory of the Products, a different version of these Terms of Sale may apply.
If this is the case, such different version will be presented to you on the Website at the point of purchase. We also reserve the right to amend the terms from time to time without prior notice to you.
If we fail to enforce a right under this agreement, that failure will not prevent us from enforcing other rights, or the same type of right on a later occasion.
If any provision of these terms and conditions is held to be unlawful, invalid or unenforceable,
that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these terms and conditions shall not be affected.
We may transfer this agreement to someone else. We may transfer its rights and obligations under these terms to another organisation.
We will always tell the customer in writing (including email) if this happens and will ensure that the transfer will not affect the customer's rights under the contract.
Nobody else has any rights under this contract (except someone the customer passes his guarantee on to,
We may require the person to whom the guarantee is transferred to provide reasonable evidence that they are now the owner of the relevant item or property).
This contract is between the customer and Cheerble. No other person shall have any rights to enforce any of its terms.
1.2 You agree and warrant that the purpose of the purchase hereunder is for your personal use as an end user, and not for resale of the Products (or any part or component thereof) to any third party or otherwise whatsoever.
1.3 You shall not assign or transfer any rights or obligations under the Contract to any third person without our prior written consent thereto.
1.4 Cheerble will only accept Orders for delivery in countries/regions which are listed for you to select as the shipping destination during the order placing process.
We reserve the right to amend the list of shipping destination from time to time without prior notice to you.
1.5 We reserve the absolute discretion to accept or decline the Order without ascribing any reason in respect thereof.
2.2 All prices quoted on the Website are subject to adjustment at our absolute discretion at any time and from time to time without prior notice to you.
2.3 The purchase price of the Products (“Price”) shall be the price specified in the Confirmation. Notwithstanding the foregoing, we reserve the
sole and absolute right to adjust the Price to reflect any change in the cost of the Products due to any unforeseen circumstances and / or factors beyond our
reasonable control, including without limitation, any foreign exchange fluctuation, currency regulation, change in tax duties / levies, increase in the costs of
labour and materials or other costs of manufacture, change in delivery schedule at your request, or belated instructions or failure to supply us with requisite information or instructions on your part.

4.2 Purchases must be made during the specified promotional period to qualify.
5.2 Cheerble reserves the right to decline orders where, in its opinion, a discount code is invalid for the order being placed.
5.3 Discount codes are not valid in conjunction with any other promotion.
5.4 In the event of product returns, refunds will be given for cash used in the original purchase once the promotion is applied, minus any shipping, gift wrap, or gift card costs charged on the original order.
5.5 In the event of part of the order being returned, the value of the promotion applied on that order will be spread between the goods proportionately. The sum in cash exceeding this value, minus any shipping,
gift wrap, or gift card costs charged on the original order, will be returned to the customer.
6.2 You are responsible for ensuring the accuracy of all information provided in connection with your Order, including but limited to your designated delivery address and your contact details.
We will not be liable for any failure or delay or otherwise in discharging our obligations and / or performing our duties under the Contract if such default is in any way due to the incomplete and / or inaccurate information provided by you in respect of the Order.
6.3 Notwithstanding, after confirming your order, if you need to update items on your order or edit the delivery address, please contact us as soon as possible. We will endeavor to assist you but we do not guarantee a successful
amendment even your request ticket is submitted before your order is shipped.
7.2 Notwithstanding delivery and the passing of risk in the Goods or anything contained herein, the title to the Goods shall not pass until the total price of the Order under which it is ordered has been paid in full.
● Report the damage on the delivery note submitted by the carrier
● Take pictures of the damaged goods including the packaging used
● Report the damage to Cheerble by submitting a support ticket via Cheerble website
Cheerble would accept order cancellation before order is shipped. For any order has been shipped, the case will be handled subject to Clause 9.2. We reserve our sole and absolute right and discretion to decline any request under this Clause
9. In the event of any dispute hereunder, our determination shall be final and conclusive.
9.2 7-day No Reason Return of Goods
The good may be returned for a full refund for any reason within 7 days of the date the item was delivered to the Delivery Address. To do so, you must submit a support ticket(help.cheerble.com) or send an email to firstname.lastname@example.org

. in this 7-day window and provide a tracking number for the return shipment within 3 working days of receiving our response.
9.2.1 Once the returned item arrives back in Cheerble’s warehouse for inspection, the refund process will begin subject to satisfaction of requirements below:
● Goods must be returned in its original unaltered condition
● Goods must be returned in its original packaging
● Gift(s) or any enclosed item(s) shall be returned simultaneously
9.2.2 Refund requests for the 7-day No Reason Return of Goods expire 7 days after opening a warranty claim. It is not possible to process a request for a refund for non-quality issues for items that have expired this 7-day window.
9.3 Promotional bundle returns
When a bundle is purchased and only part of the bundle is returned, the bundle discount is void, and the total bundle discount will be deducted from the refund. For example,
if you receive a $50 savings when you purchase a Cheerble Wicked Ball and Wickedbone together and you return either item separately, the $50 savings will be subtracted from your refund.
Also, we do not accept returns or exchanges of Cheerble products purchased from other retailers.
Cheerble warrants a list of Cheerble products directly sold by us or sold by some of our authorized dealers, against any quality-related defects. Please refer to details in Cheerble Limited Warranty.
9.5 Shipping costs
Shipping costs must be covered by you in the following situations:
● Returning products for any reason other than a proven defect
● Warranty claims on items taken outside the original country of purchase (offline purchases)
● Warranty claims on items taken outside the original destination country for order fulfillment (online purchase)
● Your accidental returns
● Returning personal items
● Returning items claimed to have defects but found by Cheerble to be in working condition
● Costs associated with unauthorized returns (any returns made outside of the approved process of Cheerble Limited Warranty or 7-day No Reason Return of Goods)
9.6 Returning the product
Place the item(s) in a package and indicate on a note your order ID, email address and reason for returning. Send the item(s) to the address we provide to you as we reply to your request ticket.
10.2 Refund of payment shall be made to the original payer only.
10.3 Cheerble shall be allowed to have 10 working days to proceed and initiate your refund.
4. By furnishing the Information to us, you are agreeing to our use of the Information as set out herein.
11.1 Collection of the Information shall be for the purposes of:
(a)providing you with the Goods in accordance with your Order;
(b)maintaining our records relating to you and your Order, in order that we may provide maintenance, guarantee and other services to you (if applicable);
(c)sending you information relevant to your Goods and advertising and promotional materials which may be of interest to you;
(d)determining the amount of any payment owed to or by you (if any);
(e)collecting any amounts outstanding from you; and / or
(f)any purposes directly and indirectly relating to any of the foregoing.
11.2 We will keep the Information confidential, but we may from time to time provide the Information to:
(a)any governmental or statutory authorities pursuant to statutory or judicial order or in compliance with applicable laws;
(b)any other member(s) or affiliate(s) of Dancom; and / or
(c)any other person on a need-to-know basis who is under a duty of confidentiality to us, such as our authorized service providers which include the Payment Processor.
11.3 We will not accept any responsibility or liability whatsoever for any loss or damage suffered or incurred by you as a result of any use or misuse of any of the Information by any third party under whatever circumstances.
You acknowledge and agree that your provision of the Information is made entirely at your own risk.
WHETHER DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR OTHERWISE (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR COSTS OF OBTAINING SUBSTITUTE GOODS OR SERVICES),
ARISING OUT OF OR IN CONNECTION WITH THE PRODUCTS OR THE SITES, WHETHER OR NOT CHEERBLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND WHETHER BASED UPON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY,
VIOLATION OF STATUTE, OR OTHERWISE. THIS EXCLUSION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. IN ANYEVENT, OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT TO WHICH THE CLAIM RELATES OR,
IF THE CLAIM DOES NOT RELATE TO A PRODUCT, $100.
CHEERBLE DOES NOT WARRANT, ENDORSE, GUARANTEE OR ASSUME RESPONSIBILITY FOR ANY PRODUCT ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE SITES OR ANY WEBSITE FEATURED OR LINKED TO THROUGH THE SITES, AND CHEERBLE WILL NOT BE
A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. CHEERBLE WILL NOT BE LIABLE FOR THE OFFENSIVE OR ILLEGAL CONDUCT OF ANY THIRD PARTY.
YOU VOLUNTARILY ASSUME THE RISK OF HARM OR DAMAGE FROM THE FOREGOING. THE FOREGOING LIMITATIONS WILL APPLY EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE AND TO THE FULLEST EXTENT PERMITTED BY LAW.
